1. Acceptance of Terms
By accessing or using Swoon ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and Swoon. Your continued use of the Platform after any changes to these Terms constitutes acceptance of such changes.
2. Eligibility
You must be at least 18 years of age to use Swoon. By creating an account, you represent and warrant that you are at least 18 years old. Age verification is required during registration. Swoon reserves the right to request additional proof of age at any time and to suspend accounts where age requirements are not met.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must not share your login information with any third party. You agree to immediately notify Swoon of any unauthorized use of your account. Swoon is not liable for any loss arising from unauthorized access to your account. You may only maintain one account per person.
4. Virtual Currency (Coins)
Coins are a virtual currency used exclusively within the Swoon platform. Coins have no real-world monetary value and cannot be exchanged for cash except through the creator payout program. Coins purchased are non-refundable except as required by applicable consumer protection laws. Unused coins remain in your account indefinitely but cannot be transferred between users. Swoon reserves the right to modify coin pricing with reasonable notice.
5. Creator Revenue
Creators earn a percentage of coins received through various platform features: tips and gifts (92%), subscriptions (90%), and predictions (85%). Earnings are subject to a 14-day hold period for subscriptions before becoming available for withdrawal. Withdrawals can be made to a connected bank account, subject to a minimum threshold of 10,000 coins (equivalent to €100) and identity verification requirements. An 8% platform fee applies to all payouts. Swoon reserves the right to withhold payouts if fraud or Terms violations are suspected.
6. Content Guidelines
Users must not post, stream, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable. Content involving minors is strictly prohibited. Swoon reserves the right to remove content and suspend or permanently ban accounts that violate these guidelines without prior notice. Creators are solely responsible for ensuring their content complies with all applicable laws in their jurisdiction.
7. Intellectual Property
All content streamed or uploaded to Swoon remains the intellectual property of the respective creator. By using Swoon, you grant Swoon a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content within the platform and for marketing purposes. You may not copy, download, redistribute, or reproduce any content from the platform without the explicit consent of the content creator. Swoon's trademarks, logos, and branding may not be used without written permission.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Swoon and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Swoon's total liability for any claim arising from these Terms shall not exceed the amount you paid to Swoon in the 12 months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.
9. Dispute Resolution & Governing Law
These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from or relating to these Terms or your use of the Platform shall first be attempted to be resolved through informal negotiation. If a dispute cannot be resolved informally within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of Paris, France. Nothing in this clause limits your rights under mandatory consumer protection laws of your country of residence.
10. Modifications to These Terms
Swoon reserves the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 30 days before taking effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Platform and may request account deletion.
11. Termination
Swoon may terminate or suspend your account at any time for violations of these Terms, with or without notice depending on the severity of the violation. You may delete your account at any time through the Settings page. Upon termination, your right to use the Platform ceases immediately. Creators with outstanding balances will receive their final payout according to the standard payout schedule, minus any applicable fees, provided no fraud or Terms violations are under investigation.
